Civil
law (or civilian law) is a legal system originating in Europe,
intellectualized within the framework of late Roman law, and whose most
prevalent feature is that its core principles are codified into a
referable system which serves as the primary source of law. This can be
contrasted with common law systems whose intellectual framework comes
from judge-made decisions law which gives presidential authority to
prior court decisions on the principle that it is unfair to treat
similar facts differently on different occasions (doctrine of judicial

Property
law is the area of law that governs the various forms of ownership and
tenancy in real property (land as distinct from personal or movable
possessions) and in personal property, within the common law legal
system. In the civil law system, there is a division between movable and
immovable property. Movable property roughly corresponds to personal
property, while immovable property corresponds to real estate or real
property, and the associated rights and obligations thereon.
In
some jurisdictions, historically all property was owned by the monarch
and it devolved through feudal land tenure or other feudal systems of
loyalty and fealty.

Real
estate is "Property consisting of land and the buildings on it, along
with its natural resources such as crops, minerals, or water; immovable
property of this nature; an interest vested in this; (also) an item of
real property; (more generally) buildings or housing in general. Also:
the business of real estate; the profession of buying, selling, or
renting land, buildings or housing."
Mutation/Transfer
Mutation
is the recording of a transfer of title of a property from one person
to another in the revenue records. The documentation procedure to be
followed and the fee payable vary from State to State. The mutation in
the municipal records is for the purpose of payment of property tax, and
it does not mean a legal title for the person in whose name the
property has been mutated in the municipal records.
Partitioning
A
partition is a term used in the law of real property to describe an act,
by a court order or otherwise, to divide up a concurrent estate into
separate portions representing the proportionate interests of the
tenants. Under the common law, any tenant who owns an undivided
concurrent interest in land can seek such a division. In some cases, the
parties agree to a specific division of the land; if they are unable to
do so, the court will determine an appropriate division. A sole owner,
or several owners, of a piece of land may partition its/their land by
entering a Deed poll (sometimes referred to as "carving out").There are
three kinds of partition which can be awarded by court: partition in
kind, partition by allotment, and partition by sale. A partition in kind
is a division of the property itself among the co-owners. In a
partition by allotment, which is not available in all jurisdictions, the
court awards full ownership of the land to a single owner or subset of
owners, and orders them to pay the person or persons divested of
ownership for the interest awarded.
Sales Deed
Everyone's
dream is to own a property. Obviously you need money to buy a property,
but many recent instances of fraud and bogus selling of property is
something that is beyond money alone. If there is one important thing
that gives legal protection to ownership of your property, it is the
sale deed.A sale deed is one of the most valuable legal documents in a
purchase or sale of a property. It is governed by the Registration Act
and is an important document for both the buyer or the transferee and
the seller or the transferor.
The
purchase or sale of property is not legally complete until a sale deed
is signed between the buyer and the seller. Usually a sale deed is
signed only after both the parties are satisfied and comply with the
terms and conditions as said in the agreement.
